NYS Driver Violation Point System
The DMV driver violation point system helps to identify drivers who commit several traffic violations during a specific time period.
Remember that the point system is not the only reason for a driver license suspension or revocation. There are mandatory suspensions or revocations. For example, the DMV must revoke your driver license if you are convicted of three speeding violations within an 18-month period and you have fewer than 11 points. This lists the number of points given for specific traffic violations: Speeding (MPH over speed limit not indicated)= 3 points Speeding (MPH over speed limit): 1 - 10 MPH = 3 points 11 - 20 MPH = 4 points 21 - 30 MPH = 6 points 31 - 40 MPH = 8 points More than 40 MPH = 11 points Reckless driving = 5 points Failed to stop for a school bus = 5 points Inadequate brakes = 4 points Following too closely = 4 points Passing improperly, changing lanes unsafely, driving to the left of center, driving in the wrong direction = 3 points Failed to obey a traffic signal, a Stop sign, or a Yield sign = 3 points Railroad crossing violation = 3 points Failed to yield the right-of-way = 3 points Passenger safety violation, including seat belts, child safety seats, or passengers under the age of 16 = 3 points Left the scene of an accident that includes property damage or the injury of a domestic animal = 3 points Other moving violations = 2 points Inadequate brakes (vehicle of an employer) = 2 points How the DMV Calculates Your Point Total The DMV computer system automatically calculates your point total. Your point total is the total number of driver violation points that you received during the 18 previous months. The points are counted from the dates of your traffic violations, not from the dates of your traffic convictions. A traffic conviction is required for the points to appear on your driver record. 18 months after the date of the violation, the points for that violation are removed from your point total. The convictions remain on your record. Learn more about convictions and your driver record. If you receive 11 points or more in 18 months, the DMV suspends your driver license. You can request a DMV hearing only to show that a different person committed the violations. You cannot request a DMV hearing to prove that you were not guilty of the violations. You cannot request a DMV hearing to request a waiver of the suspension. Note: Insurance companies have point systems different from the DMV driver violation point system. The two point systems have no connection. Contact your insurance company about their point system. Out-of-state traffic violations: Except for Ontario and Quebec, points are not added to your NYS driver record if you commit an out-of-state traffic violation. Points can appear on your NYS driver record if you commit a traffic violation in Ontario or Quebec. |

I got 6 points from the only ticket I got in my life. I heard that if you get something like 10-20 people together, you can have a DMV defensive driver course intructor host a "special" 3-6 hour course, and instead of only taking 2 points off it takes 4 points off your liscence. Anyone have any more info on this?

Read this section completely. Not all DMV records are available by the same method. There is a fee of $6 for each search that is made. There is no guarantee of the results of the search. The fee is not refundable. Personal checks or money orders must be made payable to "Commissioner of Motor Vehicles". If your request for a driver abstract does not include a DPPA permissible use, you will receive only a masked abstract. An explanation of a masked abstract appears below. At the DMV web site If your address has not changed, you can order an abstract of your driver record on-line. You must provide the information from your driver license to prove your identity and you must use a credit card to pay the fee. The search fee is $6. It will help refresh your driving knowledge with a review of time-tested safe driving tips and an overview of today's vehicle and traffic laws. You may be eligible to reduce as many as four (4) points on your driving record. The DMV computer will automatically note your eligibility to receive the reduction. If you are the principal operator of a motor vehicle, you will receive a 10% reduction in the base rate of your automobile and motorcycle liability and collision insurance premiums each year for three years. If we can get enough people, I will make a call and set up a "B20vtec" defensive drivers course....... |
